ISLAMABAD: An Islamabad civil court has issued bailable arrest warrants for the Chairman of the Capital Development Authority (CDA) and the Islamabad Commissioner over the non-implementation of a court decree concerning an affected landowner.
Civil Judge Naseeruddin issued the warrants while hearing an application seeking implementation of a decree passed in favour of petitioner Muhammad Rashid in 2000. The case subsequently reached the Supreme Court, which upheld the decision.
According to the petitioner, the CDA acquired his land in Mouza Badiya Qadir Bakhsh, but the benefits and compensation available under the authority’s rehabilitation and resettlement policy had not been provided.
Counsel for the petitioner told the court that the decree had still not been fully implemented and requested effective enforcement of the court’s decision.
The court, taking note of the continued non-compliance, issued bailable arrest warrants for the CDA chairman and Islamabad commissioner and directed the relevant authorities to ensure implementation of the decree.
The court also warned that further legal proceedings could follow if its directions were not complied with.
The case highlights a long-running dispute over the implementation of rehabilitation and resettlement benefits following land acquisition by the CDA.
