ISLAMABAD: The Islamabad High Court has ordered to decide the appeal against this contempt of court within a month.
Advocate Salman Akram Raja, representing Bushra Bibi, asked why the case was transferred to the Additional Sessions Judge. He said that it should be heard by Sessions Judge Shah Rukh Arjmand to give a fair verdict to the trial court or the Supreme Court itself should hear the appeal.
As a third option, if the appeal is left by the West Judge Session, the court must set a time for the appeal to the Court Session, he said. Earlier this Court was heard by the East, but now it has been transferred to the West by the Sessions Judge. The hearing was held over two days and the appeal was to be heard immediately.
Also, Khawar Maneka’s representative, Raja Rizwan Abbasi, objected to the transfer of the trial from the Additional Sessions Judge to the court and filed a complaint against the judge Khawar Maneka, which the court rejected.
Rizwan Abbasi admitted that when Khawar Maneka objected, the session judge referred the matter to the High Court. The High Court Administrator ordered the application to be forwarded to the Additional Sessions Judge West. The order of this Court Administrator cannot be challenged directly or indirectly.
The Islamabad High Court, after hearing the arguments of the lawyers of both parties, decided on the petition to stay within 10 days and disposed of the contempt appeal within a month.
