Islamabad: The Supreme Court disposed of the petition filed in the human rights case against Faiz Hameed on the charge of land grabbing.
Disposing of the petition, the court said that the petitioner has three forums against Faiz Hameed and other retired parties and the petitioner can approach the Ministry of Defence, civil or criminal court if he wants, so the Supreme Court can do this without touching the merits of the case. Handles requests.
The Additional Attorney General argued that he has his own institution to take action against a retired army officer, if the allegations are proved, the retired officer can be reinstated and court martialed.
According to the court order, the Additional Attorney General said that the defense ministry, ordinary criminal or civil court is also available to take action against the retired army officer.
At the commencement of the hearing, the Supreme Court granted time to petitioner Mueez Ahmed’s counsel to file affidavits.
During the hearing, Chief Justice Qazi Faiz Isa, speaking to the petitioner, said that you have made serious allegations in the petition, whether you will appear in the case yourself or through a lawyer.
The petitioner said that my lawyer did not submit the representation, we got a call only yesterday, so the case should be adjourned.
The Chief Justice of Pakistan remarked that they cannot even postpone your case, so you should submit the lawyer’s letter, then the case will be heard.
The hearing resumed after a break on the application against General (R) Faiz Hameed, then the lawyer for the petitioner stated that on May 12, 2017, Moeez Khan and his family were abducted.
The Chief Justice said in his remarks that what can the court do in this regard? Did the Supreme Court take any notice on this issue?
The petitioner’s lawyer said that the Supreme Court had not taken any action directly, the Ministry of Defense is authorized to conduct an inquiry.
The Chief Justice remarked that the application of a woman named Zahida is also pending.
Lawyer Mueez Ahmed said that Zahida has passed away, if they give a copy of the application, they will review it. The Chief Justice remarked that he cannot give a date after the review, he will hold the hearing after the tea break.
The Chief Justice of Pakistan, talking to the petitioner’s lawyer, said that we are telling you what we have understood so far from this case, British citizen Zahida Aslam filed a case under Article 184 three in the Supreme Court in 2017 and former Chief Justice Saqib Nisar called the parties in his chamber in November 2018 and conducted the case.
